ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326 of BNS in Crime No.166 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that based on the secret information, the respondent police went to the scene of occurrence and found that the petitioners had illegally quarried and transported 1⁄4 unit of river sand by using Bolero Pickup. Hence, the case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and submitted that the first petitioner is having three previous case of similar nature and the second 2/4

petitioner is having one previous of similar nature. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the nature and gravity of offence that the petitioner had illegally quarried and transported river sand and caused damage to ecology and water bodies, I am not inclined to grant anticipatory bail to the petitioners.

6. Accordingly, this Criminal Original Petition stands dismissed. 25.02.2026 Vv To
