Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent to 1/5

consider the representation dated 28.06.2023 and 29.01.2024 and directing the 4th respondent to disburse the monthly salary to the petitioner.

ORDER

This Writ Petition has been file for a direction directing the fourth respondent to disburse the salary to the petitioner.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner's husband, while he was working as Over Head Tank Operator in the fourth respondent Panchayat, died on 21.03.1998. Thereafter, the petitioner had joined on 03.10.1999 as Over Head Tank Operator in the fourth respondent Panchayat. However, for the past ten months she was not paid any salary by the fourth respondent. Therefore, the petitioner submitted a representation before the first respondent, which is still pending. Hence, the writ petition. 2/5

4. The learned Special Government Pleader appearing for the respondents 1 to 3 submitted that the petitioner had attained the age of superannuation and she had not been engaged so far in the work of Over Head Tank Operator.

5. In view of the above submission, if the petitioner engaged in the post of Over Head Tank Operator, she is entitled for monthly salary. Therefore, for whatever the work that was extracted from the petitioner, the fourth respondent is bound to pay salary. Accordingly, the fourth respondent is directed to pay salary for the work done by the petitioner as Over Head Tank Operator within a period of four weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition stands disposed of. No costs.
