ORDER

The petitioner, who was arrested and remanded to judicial custody on 14.12.2025 for the alleged offence under Sections 4 Non Act, section 5(1), 6(1) of POCSO Act in Crime No.122 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner herein had developed relationship with the victim girl aged about 15 years through Instagram under the pretext of love, kidnapped her to his house and committed aggravated penetrative sexual assault and based on the complaint lodged by the victim's mother, 'girl missing' case was registered and subsequently after securing the girl, the offence was altered and the case was registered.

3. The learned counsel for the petitioner would submit that the petitioner herein is aged about 24 years and was not known to the victim girl. The victim girl herself went somewhere voluntarily and without recording the statement of the victim girl, the petitioner has been falsely implicated in this case and is ready to cooperate with the investigation and the petitioner is in incarceration from 14.12.2025. Therefore, he prays for grant of bail to the petitioner.

The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner had kidnapped her and taken her to his house and confined her and also committed aggravated penetrative sexual assault on her and the investigation in this case is pending. Hence, he vehemently opposed the grant of bail to the petitioner.

5. I have gone through the statement recorded from the victim by the

police and also the alteration report and it revealed that the petitioner is alleged to have committed aggravated penetrative sexual assault after kidnapping her to his house and the age of the victim is 15 years, this court is not inclined to grant bail to the petitioner.
