No.F1.Tha.Pa.51/2021 Vithi-3 (AA) dated 23.06.2022 and quash the same is illegal, incompetent and Ultra virus and consequently directing the 1st Respondent to reinstate the Petitioner in the post of the constable with all back wages and monetary benefits within a stipulated the frame. ORDER

The writ petition has been filed for the following relief: "to call for the records of the proceedings of the respondents in order passed by the 1st Respondent review proceedings in Rc. No.4766959/AP.1(1)/2023 dated 12.05.2025 by confirming the rejection order passed in appeal by the 2nd Respondent through proceedings No.C.No.D2/AP-27/2022 dated 12.11.2022 in confirming the order of Dismissal from service passed by the 3rd Respondent through his proceedings Tha. Pa. No.F1.Tha.Pa.51/2021 Vithi-3 (AA) dated 23.06.2022 and quash the same is illegal, incompetent and Ultra virus and consequently directing the 1st Respondent to reinstate the Petitioner in the post of the constable with all back wages and monetary benefits within a stipulated the frame."

2. It is the case of the petitioner that the petitioner was working as a Police Constable at Avinashipalayam Police Station which was formerly Avinashi Police Station at Tiruppur District. In the course of his duty, the petitioner was enjoined with the duty of escorting the accused for remand before

the learned Magistrate. During one such case, the petitioner had escorted an one Anandan who was an accused in Cr.No.1639 of 2020 under Section 457, 380 r/w 411 of IPC and another case in Cr.No.1695 of 2020 under Section 457, 380 r/w Section 411 of IPC for remand before the learned Magistrate. 2.1. The petitioner would submit that the learned Magistrate has remanded the said prisoner and the accused had handed over his ATM card to the petitioner. The accused has begged the petitioner to take the ATM Card stating that would be seized in the jail. On such compulsion, the petitioner had received the ATM Card. Thereafter, the said Anandan requested him to withdraw the money whenever his mother required money. He had requested the petitioner to hand over the ATM Card to his mother.

However, since his mother was an old woman and believing that the card could be misused by others, the petitioner kept the card with him and he had been withdrawing the money as and when required by the said Anandan's mother. 2.2. When the accused was released, the petitioner was on duty elsewhere and he was, therefore, unable to contact him to hand over the ATM Card. The said Anandan had lodged the complaint pursuant to which, an action was initiated against the petitioner and since the charge was proved, he was dismissed from service vide orders of the third respondent dated 23.06.2022.

who had rejected the same by his order dated 12.11.2022. The petitioner would submit that he has repaid the entire money to the said Anandan. The petitioner's review petition dated 27.01.2023 before the first respondent has also been rejected. Challenging the same, this writ petition has been filed.

3. Heard the learned counsel on either side and perused the materials available on record.

4. The charge against the petitioner is that he has taken the ATM Card of a remand prisoner and has withdrawn the money and not returned the ATM Card to the said prisoner. The petitioner has also admitted to withdrawing the said sums and submitted that he has also repaid the amounts to the said Anandan. However, the fact remains that the petitioner has illegally withdrawn money using the ATM Card of an another person.

5. In the affidavit filed in support of this petition, the petitioner also stated that he had been withdrawing the money and handovering the same to the said Anandan's mother. However, the said statement appears to be incorrect and has not been proved in any manner. The Enquiry Officer conducted an oral enquiry held the charge was proved, the petitioner has also admitted to receiving the ATM card and the drawal of money. Further, the petitioner belong to the Uniformed Service and honesty and probity is expected from them. The person

from whom the ATM card has been taken is a prisoner who was being escorted by the petitioner. The safety and security of the accused is in the hands of the petitioner and that being the case, misusing the ATM card of the prisoner amounts to a breach of truth and a misconduct. Since, no grounds has been made out by the petitioner for setting aside the impugned order, I see no reason to interfere with the impugned order.

Accordingly, this writ petition is dismissed. Consequently, connected miscellaneous petitions are closed.
