..Respondent Prayer:- Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondent for payment of gratuity arrears to the petitioner reckoning the revised pay of him which came into existence from 01.09.2010 itself before his superannuation dated 31.12.2010 which was computed as last drawn pay for the purpose of payment of pension and salary arrears to him and to stipulate rate of interest by this Court for the arrears amount of gratuity by fixing the time limit for payment For Petitioner : Mr.A.Rajendiran For Respondent : Mr.A.Sundharavadhanam Standing counsel

ORDER

(1)Though the prayer sought for in the writ petition is for a writ of mandamus seeking for certain relief with regard to the gratuity arrears allegedly due payable to the petitioner from the respondent/Transport Department, the fact remains that on 08.08.2017, having considered the plea raised by the petitioner in this regard, it was rejected by the respondent and an order to that effect has been passed.

(2)Having receipt of the order and having filed the same in the typed set of papers, however the petitioner has not chosen to challenge the said order and only seeks for a mandamus as stated above.

(3)After realising these factors, the learned counsel for the petitioner wants to withdraw this writ petition with liberty to challenge the said order dated 08.08.2017 in the manner known to law.

(4)With the said liberty, this writ petition is dismissed as withdrawn. No costs.
