This writ petition has been filed challenging the order passed in proceeding No.DC4/7088/2016 dated 09.02.2024 by the respondent.

It is seen that the petitioner also filed appeal before the appellate authority and it is pending for consideration. Therefore, the writ petition itself is not maintainable when there is appeal remedy available. Without exhausting the appeal remedy, this writ petition has been filed. As such, this writ petition is liable to be dismissed. 3.

However, the appellate authority is directed to dispose of the aforementioned appeal, after giving opportunity of personal hearing to the petitioner and on production of relevant documents by the petitioner, within a period of twelve weeks from the date of receipt of this order. Till then, there shall not be any recovery as per the order dated 09.02.2024 from the petitioner.

With the above direction, this writ petition is dismissed as not maintainable. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
