This application is filed seeking for grant of leave to file the present suit before this Court against the 4th respondent herein, who is residing outside the jurisdiction of this Court.

2. The applicant as the plaintiff seeks to file the present suit for specific performance of an Agreement of Sale dated 10.09.2014, in respect of the suit property which is situated at T.Nagar, Chennai, within the jurisdiction of this Court. It is further stated that the 4th respondent who is a subsequent purchaser of the suit property is residing outside the jurisdiction of this Court whereas, all other respondents are residing within the jurisdiction of this Court.

3. Considering the fact that the suit property is lying within the jurisdiction of this Court and the suit is for specific performance of an Agreement of Sale and also, in view of the fact that the other respondents namely, respondent Nos. 1 to 3 are residing within the jurisdiction of this Court, this Court is of the view that the part of cause of action has arisen for the plaintiff to file the present suit
