ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 303(2) and 326(a) of BNS in Crime No. 19 of 2026, seek anticipatory bail.

2. The allegation against the petitioners is that the petitioenr along with five other accused, were involved in illegally quarrying sand from the Thenpennai River and dumping it in a housing plot belonging to A1. On receiving information, the Village Administrative Officer lodged a complaint, based on which the present case has been registered.

3. The learned counsel for the petitioners submits that the FIR was

registered against unknown persons and the petitioners have been falsely implicated and are ready to cooperate with the investigation. Hence, he prays for anticipatory bail.

4. The learned Government Advocate (Crl. Side) reiterates the prosecution case, stating that three accused have been arrested and, based on their statements it revealed that the petitioners were involved in illegal quarrying sand from the Thenpennai River, which is the lifeline of the northern districts. She opposes to grant anticipatory bail to the petitioners.

5. This Court has perused the FIR and connected materials, revealed that the petitioners acted as a gang involved in illegal quarrying sand and dumping 9 units in A1's land. The second petitioner has one previous case, and the fifth petitioner has two previous cases.

6. Considering the fact that huge quantity of sand recovered and it is a case of damaging the ecology and environment, this Court is not inclined to grant bail. Accordingly, this Criminal Original Petition is dismissed. 26-02-2026 MPA
