ORDER
This Criminal Original Petition has been filed praying to direct the second respondent herein, not to harass the petitioner. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent Police. 3.The respondent Police have filed counter, in which, they have stated as follows:
Inspite of repeated advice by law enforcing agencies not to use the public path by litting fire for preparation of food, he has not shown any inclination to stop. Hence a petty case No.189 of 2015 on 25.05.2015 early morning was filed for offences under Section 71 cl(ii) CP Act and 74 cp Act. Miffed by this the petitioner has chosen to https://hcservices.ecourts.gov.in/hcservices/
target the Police by sending petition against them. The petitioner has not chosen to deny or admit the case which is pending for his appearance.
The enquiry furthered reveal that he is being treated for his mental ailment by the care taken by his wife and it appears that he has taken an O.P Chit for some ailment.
Subsequently, on registration of the case. He has not amended his acts of commissions and omissions inspite of the advice not to encroach on public path.
4.In view of the above, no positive direction can be issued as prayed for by the petitioner. This Criminal Original Petition is closed with the above direction.
