ORDER
(Order of the Court was made by M.S.Ramesh, J.) On the ground that the petitioner's husband would be eligible for premature release under G.O.(Ms).No.1155, dated 11.09.2008 and G.O.(Ms).No.64 of 2018, dated 01.02.2018, a Co-ordinate Bench of this Court had granted interim bail for three months on 09.11.2023 in W.M.P.No.31581 of 2023. Thereafter, https://www.mhc.tn.gov.in/judis the interim bail was periodically extended. Even though more than one year
had lapsed after the interim bail was granted, the Government had neither filed their counter-affidavit in the Writ Petition nor they have considered the petitioner's representation seeking for premature release for her husband. 2.In this background, we are of the view that the interim bail granted on 09.11.2023 and thereafter, extended till date, be further extended until a final decision is taken in the matter by the respondents. 3.Accordingly, this Writ Miscellaneous Petition stands allowed and the extension of interim bail granted on 04.12.2024 to the detenu namely Mohamed Zubair @ Sheik Janu, S/o.Sheik Mohideen, aged about 53 years, Convict No.3243, detained at Central Prison, Coimbatore, shall stand extended until further orders.
