[Order of the Court was made by R.SURESH KUMAR, J.] Heard Mr.G.Anandakumar, learned counsel for the petitioner and Mr.K.Rajkumar, learned Standing Counsel appearing for the respondent TANGEDCO.
2. Though the learned counsel appearing for the petitioner/ appellant had stated that due to some technical glitches, he could not attend in the Video-Conference, we are not inclined to accept the said reason as there has been absence consecutively for three hearings, that is why the earlier Division Bench on 01.12.2021 dismissed the Writ Appeal for non-prosecution.
3. Anyhow the learned counsel for the petitioner/appellant since make a fervent appeal before this Court that the valuable rights of the parties cannot be deprived because of this order of dismissal on default 1/3
ground, we feel that the petition can be accepted, however, on terms.
4. Therefore, this petition is ordered on condition that the petitioner/appellant shall deposit a sum of Rs.5000/- (Rupees Five Thousand only) to the High Court Legal Services Committee attached to this Court within a period of two weeks from the date of receipt of a copy of this order, failing which, this order of restoration would get automatically vacated.
