ORDER : The Court Made the following order :- The petitioner/A2, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 379, 430 of I.P.C. R/w Sec.21(1) of MMDR Act, in Crime No.93 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and other accused persons transported 5 unit of river sand illegally in his JCB without any permission. Hence, the complaint. 3.Learned counsel for the petitioners would submit that the petitioner is an innocent person and he did not commit any offence as alleged by the prosecution. Hence he prays for grant of anticipatory bail to the petitioner.

4.Learned Additional Public Prosecutor would submit that the quantity of river sand involved is 5 unit. He would further submit that there are seven previous cases pending against the petitioner. 5.Taking into consideration the nature of offence committed by the petitioner and also the submission made by the learned Additional Public Prosecutor that the petitioner is an habitual offender and also involved in seven previous cases similar in nature, therefore this Court is not inclined to grant anticipatory bail to the petitioner.
