PRAYER: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records pertaining to impugned notice issued by the 2nd respondent vide Ref.U-12021/04/2024MEC dated 14.02.2025, thereby not eligible to participate in stray vacancy round and quash the same as illegal, incompetent and without jurisdiction and further, direct the 2nd respondent to permit the petitioner to participate in the Stray Round NEET-PG counselling 2024 by way of enabling website portal of the petitioner's login.

This writ petition has been filed challenging the order dated 14.02.2025 passed by the 2nd respondent, thereby declaring that the candidate who did not join their seats allotted through MCC in Round-3 are not eligible to participate in Stray Vacancy Round of PG Counselling 2024 of MCC.
2. The petitioner had completed his MBBS under graduation degree in the year 2016. Thereafter, he had applied for NEET PG and got selected to secure PG seat in India. Counselling was conducted through online mode for 4 rounds (All India Rounds 1, 2, 3; State Rounds 1, 2, 3). As per the rules of counselling, one can either join (retain) or upgrade the allotted seat in rounds 1, 2. The third round rule enables that once allotted in round 3, they would not participate and also forfeiture of fees. As far as the petitioner is concerned, he got selected in Round-3 All India Rank and allocated in the Medical Institute namely Burnpur Hospital, State of West Bengal, on 25.01.2025 for the faculty of Anesthesiology. Thereafter, he was not allowed to upgrade in stray round as per the order passed by the 2nd respondent. Therefore, this Court finds no infirmity or illegality in the order passed by the 2nd respondent and hence, the present writ petition is liable to be dismissed, as it deserves no merits.
