ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the offences punishable under Sections 273, 328 of IPC and Sections 7(i) and 20 (ii) of Cigarette and Other Tobacco Products Acts, 2003 in Crime No.18 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The petitioner herein is the co-accused in a case, where 540 kgs banned products were seized from the house of A1. The seized contraband includes variety of banned products indicating that this petitioner and other accused have stored the banned tobacco products for commercial purpose in the premises of the 1st accused. From the statement of the 1st accused, it appears that the petitioner herein, who is residing near the house of the 1st accused, along with the other accused have approached the 1st accused for storing the banned tobacco products in his house.

3. Further, from the investigation has also come to light that this petitioner has already been arrested twice in connection with the possession of banned tobacco products.

4. In the said circumstances, the abscondence of the petitioner will hamper the investigation and completion of the investigation. Further there is every possibility of re-occurrence of the crime, hence this Criminal Original Petition is dismissed. -sd/- 29/03/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
