Prayer in W.P.6065/2012 : Writ Petition under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the respondents herein to include the petitioner name in the Seniority list for the promotion panels to the posts of P.G.Assistant and High School Head Masters by taking into her service period from the date of her appointment as B.T.Assistant instead of the date of absorption to the Directorate of School Education.
For Petitioner in all W.Ps.
: M/s.Gajalakshmi Rajendran For Respondents in all Wps : Mr.S.Suresh Kumar, Government Advocate C O M M O N O R D E R Since the issue raised in all these writ petitions are one and the same, these writ petitions were grouped together and accordingly are being disposed of by this common order.
2. These petitioners were initially selected and appointed as B.T.Assistant and their subsequent promotional avenue is P.G.Assistant, for which they want to include their name in the panel and in order to get the same, each of the petitioners have given individual representations and since those representations have not been considered, they have approached this Court by filing the above writ petitions with the aforesaid prayer.
3. Heard Ms.Gajalakshmi Rajendran, learned counsel for the petitioners, who would submit that, if a direction is given to the respondents to consider the representations submitted by the petitioners and pass orders on merits and in accordance with law, the petitioners would be satisfied.
4. Heard Mr.S.Suresh Kumar, learned Government Advocate appearing for the respondents, who would submit that, whether the petitioners would be eligible and entitled to get their names included in the panel fit for promotion based on inter-se seniority in the feeder category is to be examined and accordingly whatever best can be done, would be done. In this regard, if the petitioners have given any representations and if the same are still pending, certainly the same would be considered and orders would be passed within a time frame that may be stipulated by this Court.
5. I have considered the submissions made by the learned counsel appearing on either side and have perused the materials placed on record.
6. Since the prayer sought for in these writ petitions as
has been submitted by the learned counsel for the petitioners is innocuous in nature and the petitioners, for the redressal of their grievance, have given representations in the year 2012, which have not been considered, this Court feels that, a direction can be given to the respondents to consider their representations and decide the same within a time frame.
7. Accordingly, the above writ petitions are disposed of with the following order. That there shall be a direction to the respondents especially the first respondent to consider the representations submitted by each of the petitioners dated 12.01.2012 and decide the same on merits and in accordance with law and pass orders thereon within a period of three months and communicate the same to the respective petitioners accordingly. With the above directions, the writ petitions are disposed of. No costs.
