herein to initiate appropriate department action under service Rule against the Fifth Respondent for illegal threatening and harassing the Petitioner on the pretext of a false and fabricated complaint and for conducting kangaroo court inside police station.

Heard Mr. V.Jeevagiridharan, Learned Additional Government Pleader appearing for the First to Fourth Respondents and perused the materials placed on record, apart from the pleadings of the parties. 2.
There is no representation for the Petitioner when the matter is called at 10.40 a.m. today.

The Writ Petition has been filed for directing the First to Fourth Respondents to initiate appropriate departmental action against the Fifth Respondent under Service Rules for illegally threatening and harassing the Petitioner on the pretext of a false and fabricated complaint. 2/5

It has been stated in the Counter-Affidavit dated 20.12.2017 filed by the Third Respondent as follows:- "12.
......the Sub Inspector Mr. Mani has been transferred to Bhavani on 06.06.2016 on administrative grounds. There is no need to take departmental action against the Sub Inspector Mr. Mani since he enlightened all the Petitioner legal heirs of the disputed property of 20 acres are civil in nature case and further he enlightened to partition the each 3 acres with specific schedule area as per conditional recital of the registered partition deed in DOC No. 3853 of 2009. And further the said Mr. Mani enforced the same to the village head and elders of the villagers of Periyakamatchipatti village and made request to execute proper earmarking of schedule property to the each and every legal heir with help of surveyors and revenue officials and same may be duly registered before the competent sub register office. The unbiased enquiry and his advise to the Petitioner and other legal heirs not warranted any departmental enquiry against him." 3/5
In view of the aforesaid action taken, nothing remains for further consideration in the matter.
