This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 2 and 3 to conduct the survey in the subject property based on the application submitted by the petitioner on 11.11.2024.
2. Heard Mr.T.Elumalai, learned counsel for petitioner and Mr.M.R.Gokulkrishnan, learned Additional Government Pleader appearing for respondents.
3. The petitioner is claiming right and title over the subject property through a registered partition deed dated 16.11.2009. The petitioner is also placing reliance upon the patta granted in favour of the petitioner in Patta No.2053. The petitioner wanted to conduct a survey in the subject property and hence, submitted an OnLine application by paying necessary charges on 11.11.2024. Since the same was not acted upon, the petitioner made subsequent representations, which also did not evoke any response. It is under these circumstances, the present writ 2/4
petition has been filed before this Court.
4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the respondents 2 and 3 to act upon the application submitted by the petitioner on 11.11.2024. The survey shall be conducted in line with the title document and the patta that was issued in the name of the petitioner. If there are any rival claims, such survey shall be conducted in their presence. This process shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order. This writ petition is disposed of with the above direction. No costs.
