R.PONGIAPPAN, J., Heard the learned counsel appearing for the applicant / plaintiff and the learned counsel appearing for the respondents 6 and 7 / defendants 6 and 7.

2. There was no representation on behalf of the respondents 1 to 5.

3. The present application has been filed to substitute the applicant Dr.V.Raja Ramalingam, Chairman of M/s.Kumaran Ashram Medical Trust, in the place of the deceased Chairman Trustee, Mrs.V.Sarada, in the suit in C.S.No.801 of 2017.

Now, on going through the averments found in the affidavit, which is filed along with the application, it would appear that in earlier, the suit in C.S.No.801 of 2017 has been filed by M/s.Kumaran Ashram Medical Trust, represented by its Chairman Trustee, Mrs.V.Sarada. Pending enquiry, the said Mrs.V.Sarada, was died on 24.08.2020. Therefore, this application 1/3

has been filed by the present Chairman, Dr.V.Raja Ramalingam, praying to substitute his name in the place of the deceased Mrs.V.Sarada.

Moreover, on considering the said prayer with the relevant documents, it would appear that this is an formal application for substituting the name of the applicant Dr.V.Raja Ramalingam in the place of the deceased Mrs.V.Sarada. Only if this application is ordered, the applicant has to proceed with the case with full particulars.

6. Hence, being satisfied with the reasons stated in the affidavit filed in support of the application, this application is ordered.

7. Registry is directed to carry out necessary amendments in the plaint and list the matter on 22.04.2021, for filing amended copy of the petition.
