The petitioner has filed the above Writ Petition to issue a Writ of Mandamus forbearing the respondents from initiating
patta proceedings in respect of the property measuring an extent of 0.40.5 Ares, comprised in Survey No.342/6, situated at Thondamandurai Village, Veppanthattai Taluk, Perambalur District, which was affirmed the petitioner's right by the proceedings of the 2nd respondent dated 15.10.2013.
2. The apprehension of the petitioner is that the 4th respondent is taking steps to dispossess the petitioner from his land.
3. It is brought to the notice of this court that the 4th respondent suo moto initiated proceedings for taking possession of the land belonging to the petitioner on 19.07.2013. However, the 3rd respondent by his order dated 15.10.2013, set aside the proceedings initiated by the 4th respondent and also observed that the construction of a school in the land in Survey No.342/3A was dropped, since the donor himself has withdrawn the gift deed in the year 2000 itself.
4. Mrs. K. Bhuvaneswari, learned Additional Government Pleader appearing for the respondents submitted that if the respondents initiate any proceedings for acquiring the land, the same would be done only by following the due process of law.
5. Recording the submissions made by the learned Additional Government Pleader, the Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
