ORDER

The Criminal Revision Case has been preferred as against the order dated 14.12.2023 passed by the learned Sessions Judge, Special Court for Trail of Cases under SC/ST (POA) Act, Coimbatore, in Crl.M.P.No.70 of 2023

in Spl.S.C.No.52 of 2023, thereby dismissed the petition to discharge the petitioners from all the charges.

Both the petitioners are facing charges for the offence punishable under Section 304(A) of IPC, Section 7 & 9 of the Prohibition of Employment as Manual Scavenger & their Rehabilitation Act, 2013 & Section 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. While pending the trial, the petitioners filed petition to discharge them from all the charges and the same was dismissed by the trial Court. Aggrieved by the same, the petitioners filed the present revision. 3.

Heard the learned counsel appearing on either side and perused the materials placed before this Court.

The learned Government Advocate (Crl. Side) appearing for the first respondent police submitted that while pending the revision, the trial Court framed charges as against the petitioners and the trial has also been commenced. So far, the prosecution examined 1 to 10 witnesses out of 30 witnesses. Now the matter has been posed for further examination of prosecution witnesses.

Considering the above submissions, this Court is not inclined to allow this petition. However, the personal appearance of the petitioners is

dispensed with and they shall be represented by a counsel after filing appropriate application. The petitioners shall be present before the Court below at the time of furnishing of copies, framing charges, questioning under Section 313 Cr.P.C., and at the time of passing judgment. The trial Court viz., the learned Sessions Judge, Special Court for Trail of Cases under SC/ST (POA) Act, Coimbatore, is directed to complete the trial in Spl.S.C.No.52 of 2023, within a period of six months from the date of receipt of a copy of this Order.

Accordingly, the Criminal Revision Case stands dismissed. Consequently, connected miscellaneous petition is closed. 26.08.2025 Index : Yes/No : Yes/No Speaking/Non Speaking order rts
