Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the second respondent to pass appropriate orders on the Appeal Petition dated 20.04.2016 filed against the proceedings of the third respondent passed in Na.Ka.No.3143/A1/2015 dated 21.03.2016 within a time frame to be fixed by this Hon'ble Court. ORDER

The petitioner School has come to this Court seeking issuance of a writ of mandamus, directing the second respondent to consider and dispose of the pending appeal on merits and in accordance with law, as the petitioner has got a fair chance of https://hcservices.ecourts.gov.in/hcservices/

success in the appeal. The petitioner has forwarded the proposal inflicting the punishment of removal from service on a Secondary Grade Teacher by name V.Vijayalakshmi. But the third respondentDistrict Elementary Educational Officer, Karur has rejected the same. As against that, the petitioner School has preferred an appeal before the Joint Director of Elementary Education (Aided), Chennai, the second respondent herein. As the appeal is pending for a long time, the petitioner has been advised to come to this Court.

2. Mr.P.Sanjay Gandhi, learned Additional Government Pleader, taking notice on behalf of the respondents, sought eight weeks time to consider and dispose of the appeal filed by the petitioner.

3. This Court, recording the statement of the learned Additional Government Pleader for the respondents, hereby directs the second respondent to consider the pending appeal of the petitioner on merits and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
