PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, to produce the body of his daughter Suganthi, D/o.Raja aged 17 years this Hon'ble Court and to set her liberty.

ORDER

(Order of the Court was made by RAJIV SHAKDHER, J)

1. This matter had come up, before us, for hearing on 04.12.2017. Notice was issued in this petition on that date, with a direction that it be made on 19.12.2017. 2.

However, today, in the morning session, Mr.V.M.R.Rajentran, the learned Additional Public Prosecutor mentioned the matter and requested that it be listed, as the detenue/Ms.Suganthi had been secured.

2.1. The learned Additional Public Prosecutor had, in the meanwhile, also informed the counsel for the petitioner.

3. To be noted, the assertion in the petition was the detenue/Ms.Suganthi had eloped with respondent No.3/Mr.Sakthivel.

4. Respondent No.3/Mr.Sakthivel, is also present in Court.

5. We interacted with the detenue/Ms.Suganthi, who, as per the date of birth given in the Aadhaar card, has, as it appears, reached the age of majority. The respondent No.3 also holds an Aadhaar card, which shows that, he is also a major. The detenue/Ms.Suganthi says that she has married respondent No.3/Mr.Sakthivel and therefore, would want to remain in his company.

6. In these circumstances, no further orders can be passed in the petition. The detenue/Ms.Suganthi, being a major, is free to take decisions concerning her own life. Sd/- Assistant Registrar(CS-iii) //True Copy// Sub Assistant Registrar vsm To 1.The Superintendent of Police Tirupur District.
