This application has been filed seeking leave to sue the second respondent/second defendant.
2. This suit has been filed under the admiralty jurisdiction of this Court seeking arrest and sale of the first respondent/first defendant vessel Navdhenu Purna, having IMO No.9339765, which is now lying at the Port of Tuticorin, within the admiralty jurisdiction of this Court.
3. The owner of the first respondent vessel is the second respondent. Since the second respondent is having its principal place of office at Mumbai, this application has been filed seeking leave to sue.
4. The plaintiff is a ship repairer and they claim to have rendered ship repairs on a request made by the second respondent/owner of the first respondent vessel. They claim that for the services rendered by 1/3
them, payments have not been made. In such circumstances, they have filed the present suit.
5. Since the first respondent vessel is now lying at the Port of Tuticorin, within the admiralty jurisdiction of this Court, this Court is inclined to grant leave to sue the second respondent/second defendant before this Court. Accordingly, this application is allowed as prayed for. Registry is directed to number the suit, if it is otherwise in order. 05.03.2024 rkm 2/3
