Both the counsel appearing for the petitioner and first respondent submitted that parties have settled the matter and filed a joint memo of compromise to that effect. The petitioner paid a sum of Rs.3,33,240/- (Three Lakhs Thirty Three Thousand and Two Hundred and Forty Only) by way of demand draft in favour of the first respondent in D.D.No.584899 drawn on State Bank of India dated 05.12.2017. The first respondent also acknowledges the same and submitted that there is no claim against the petitioner and the second respondent herein, pursuant to the decree passed in O.S.No.136 of 1999 dated 22.06.2001 on the file of the Subordinate Court, Hosur. The joint memo of compromise is taken on file and the same is recorded. The R.E.P.No.64 of 2003 is terminated.
The first respondent Bank is permitted to withdraw the amount deposited to the credit of R.E.P.No.64 of 2003 as per the order of this Court. 2.In the result, the Civil Revision Petition is disposed of and the joint memo of compromise shall form part of this order. No costs. Consequently, connected miscellaneous petitions are closed. 07.12.
