ORDER

The writ petition has been filed seeking a mandamus to the respondent to pay difference in leave salary and difference in gratuity with 10% interest as per 15th wage settlement dated 29.05.2025 to the petitioners. 2.

The petitioners joined the services of the respondent/Corporation as Driver, Helper and Technical Staff, rendered nearly 32 to 34 years of continuous service and retired from service on attaining the age of superannuation between 2023 and 2024. The petitioners retired from service prior to the 15th wage settlement, which was arrived on 29.05.2025, under Section 12(3) of the Industrial Disputes Act, 1947, which was given retrospective effect from 01.09.2023. As per the said settlement, the petitioners are entitled to revision of pay and consequential terminal benefits such as gratuity and leave salary with effect from 01.09.2023. However, the said

benefits have not been extended to the petitioners. Though the petitioners submitted representations dated 30.12.2025 and 06.02.2026 in this regard to the respondent, the same were not considered and therefore, in order to espouse the said cause, the petitioners have come up with the present petition. 3.

The learned counsel for the petitioners submitted that the terminal benefits payable to the petitioners were disbursed belatedly and further, the differential amounts payable under the 15th wage settlement has not been paid so far. Hence, it would suffice, if a direction is issued to the respondents to consider the petitioners' representations dated 30.12.2025 and 06.02.2026 and pass appropriate orders on merits within a time frame. 4.

Heard the learned counsel appearing for the petitioners and the learned Standing Counsel appearing for the respondent/corporation. 5.

In view of the 15th wage settlement arrived at under Section 12(3) of the Industrial Disputes Act, 1947, which entitles the employees of the Transport Corporation for revision of pay scale including gratuity and encashment of leave, the respondents are directed to implement the revised pay scales to the petitioners in terms of the said settlement along with interest at the rate of 6 % per annum. The said exercise shall be completed within a period of three weeks from the date of receipt of a copy of this order.

Accordingly, this writ petition is disposed of with the aforesaid direction. No costs.
