CMP.No.5251/2022 in SA.No.862/2017 S.S.SUNDAR, J., The present petition is filed to bring on record the 3rd appellant herein as the legal representative of the deceased 1st appellant in the above Second Appeal.

2.Though the petition is filed showing the 3rd appellant as one of the petitioners, it is found that the learned counsel did not file Vakalat on behalf of the proposed party/3rd petitioner/3rd appellant.

It is now learnt that the learned counsel has filed Vakalat for the proposed party/3rd petitioner/3rd appellant. Though there is a technical defect while filing the affidavit, this Court is not inclined to dismiss the petition on this technical ground having regard to the prayer in the petition. It is not in dispute that the proposed party/3rd petitioner/3rd appellant is the wife of the deceased 1st appellant J.Sukumar and therefore, she can be brought on record as the legal representative of the deceased 1st appellant.

3.Hence, this petition is ordered.

4.Registry is directed to post the Second Appeal for final hearing on 26.04.2022.
