Respondents Writ petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of of Declaration to declare that the selection process adopted by the Tahsildhar, Thindivanam Taluk, in selection of the candidates to the post of Village Assistants in the Thindivanam Union in Na.Ka.No.A6/382/2012 dated .08.2012 in null and void and further to direct the 1st respondent to carry on the selection process afresh to the post of village assistants in the Thindivanam Union either by a Tamil Nadu Public Service Commission or by any other selection body and by permitting the petitioner and all others to participate in the such selection irrespective of their age, place of residence or sex. ORDER
The writ petition has been filed by the writ petitioners, challenging the selection process adopted by the Tahsildhar, Thindivanam Taluk, in selection of the candidates to the post of Village Assistants in the Thindivanam Union as null and void and further to direct the 1st respondent to carry out the selection process afresh to the post of village assistants in the Thindivanam Union either by a Tamil Nadu Public Service Commission or by any other selection body and by permitting the petitioner and all others to participate in the such selection irrespective of their age, place of residence or sex. 2.Heard both sides arguments.
3.When the matter was taken up today for hearing, learned counsel appearing for the petitioners fairly submitted that though the petitioners have filed the writ petition challenging the entire selection process for the post of Village Assistant, which was carried out by the respondents 1 to 3 herein and at the relevant point of time, while entertaining the writ petition, this Court had not granted any interim order and the selected candidates have joined duty and at the distant point of time, the petitioners are not interested to disturb the selection process which was held in the year way back 2013. However, it is prayed that this Court may issue a direction to
the 1st respondent, to consider the petitioners candidature for the future vacancies.
4.On the above contention, this Court heard the learned Special Government Pleader appearing for the respondents, who has no serious objection to the passing of an order as sought for.
5.In view of the limited request sought for, this Court without going into the merits of the issue, directs the 1st respondents to consider the petitioners candidature for the future vacancies, if not considered already, in accordance with law.
