Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing respondents 1 to 3 herein to take appropriate action against respondents 6 and 7 for forming of illegal layout in the land belonging to the fifth respondent temple viz., Arulmighu Kailasanatharsami Temple, comprised in S.No.369/1 measuring an extent of 76 cents situate at Sattanathapuram Village, Seerkazhi Taluk, Mayiladuthurai District and converting the same into house sites within a stipulated time.

ORDER

(Made by the Hon'ble Chief Justice) We have heard Mr.R.Dhanasekar, learned counsel for the petitioner and Mr.N.R.R.Arun Natarajan, learned Special Government Pleader, for respondents 1 to 4.

2. The petitioner alleges illegal formation of layout in temple lands by respondents 6 and 7 and seeks action against them.

3. Mr.N.R.R.Arun Natarajan, learned Special Government Pleader, appearing for the H.R.&C.E Department submits that inquiry is in progress. If encroachment is found, then, action under Section 78 of the H.R.& C.E Act would be taken.

4. In view of the said statement, writ petition is disposed of. There shall be no order as to costs.
