This Criminal Original Petition has been filed praying to direct the respondents to give protection to the petitioner and his family members, when they visit Kazhukkanimuttam near Mayiladuthruai and Thiruindalur and also at the temple on 26.07.2015 and 27.07.2015 or on any other date before or after that.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. It is seen that this petitioner is an accused in H-2, Guduvancherry Police Station in Crime No.221 of 2015, for the offence under Section 306 IPC and that he was arrested and released on bail, by the order of this Court in Crl.OP.No.9606 of 2015 on 21.04.2015.
4. Mr.Nagalingam, Inspector of Police, Guduvancherry Police Station is present before this Court, today.
5. It is the contention of the petitioner that he is the hereditary trustee of Arulmigu Parimala Ranganathar Thirukoil in Thiruindalur, Mayiladuthurai District. It is also seen that this petitioner is a native of Kazhukkanimuttam, Mayiladuthruai District. Now the petitioner is seeking police protection for performing the rituals of the said temple on 26.07.2015 and 27.07.2015, in connection with certain functions there.
6. The deceased in this case was a practising Advocate and he hailed from the same village, Kazhukkanimuttam. The complaint in Crime No.221 of 2015 has been given by the father of the deceased by name, Manoharan, who now lives in Kazhukkanimuttam village. Under such circumstances, it is the apprehension of the petitioner that if he visits Kazhukkanimuttam and Thiruindalur, there is possibilities of family members of the deceased attacking him and therefore he is seeking police protection. 7.There appears to be some substance in the apprehension of the petitioner and therefore this Court directs the petitioner to approach the Superintendent of Police, Nagapattinam and give a written requisition, undertaking to pay the necessary charges for police protection, as adumbrated in the Police Standing Orders. On such representation being given, the Superintendent of Police, Mayiladuthrai is directed to provide sufficient police escort for the petitioner to visit Kazhukkanimuttam and Thiruindalur on 26.07.2015 and 27.07.2015.
8. With the above direction, this Criminal Original Petition is allowed.
Consequently, connected miscellaneous petition is closed.
