ORDER

(Order of the Court was made by the Hon'ble Chief Justice) In this writ petition, the petitioner has sought a writ in the nature of mandamus directing the second respondent to prevent illegal sand quarry in Survey Nos.265, 266/6 & 267 of Uriyur Village, Arakkonam Taluk, Vellore District.

2. From the averments in the affidavit filed in support of the writ petition and in particular the documents annexed to the typed set of papers filed along with the writ petition, it is patently clear that patta in respect of Survey Nos.265, 266/1 & 267 of Uriyur village has been granted in favour of one Irudhayaraj, who is allegedly carrying on quarrying of sand illegally.

3. The said Irudhayaraj not having been impleaded as respondent in this writ petition, the writ petition is dismissed for non-joinder of a necessary party as no order should be passed against him in his absence. No costs. sd/- Assistant Registrar /True Copy/ Sub Assistant Registrar bbr To:
