This Writ Petition has been filed to direct the 1st respondent to return the original sale deed presented by the petitioner for registration. 2.Admittedly, the 1st respondent has referred the matter to the Collector under Section 47-A of the Indian Stamp Act, 1899. An attempt has also been made by the 1st respondent claiming that a certain sum of money is payable by the petitioner towards deficit stamp duty.
3.Learned counsel for the petitioner would submit, on instructions, that the petitioner is willing to contest the proceedings before the Collector under Section 47-A of the Indian Stamp Act, 1899. However, he seeks for earlier disposal of the said proceedings to enable the petitioner to get back the original sale deed presented by the petitioner for registration. No prejudice would be caused to the 1st respondent if a direction is given to the competent authority to dispose of the Section 47-A proceedings within a time frame to be fixed by this Court.
4.Since the Special Deputy Collector, Coimbatore is the competent authority who is adjudicating the Section 47-A proceedings pertaining to the sale deed presented by the petitioner for registration and since he has not been
arrayed as a party respondent in this Writ Petition, this Court, by exercising its suo-motu powers, impeads the Special Deputy Collector, Coimbatore as a party 2nd respondent in this Writ Petition.
5.Mr.U.Baranidharan, learned Special Government Pleader accepts notice on behalf of both the respondents.
6.For the foregoing reasons, this Court directs the newly impleaded 2nd respondent to dispose of the Section 47-A proceedings initiated in respect of the sale deed presented by the petitioner for registration, which is the subject matter of the petitioner's representation dated 29.12.2025 and the reminder dated 13.01.2026, after providing an opportunity of hearing to the petitioner and by adhering to the principles of natural justice, within a period of twelve weeks from the date of receipt of a copy of this order. 7.With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
