CRL.O.P.NO.13439 OF 2016 S.VAIDYANATHAN, J.

The petitioner, who was arrested and remanded to judicial custody on 19.05.2016 for the alleged offence punishable under Section 174 Cr.P.C. altered into 304 (B) IPC in Crime No.746 of 2016 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner is the husband of the deceased Sudha. The marriage was solemnised on 11.05.2014 and due to their wedlock, one male child is born to them. On 16.05.2016, there was a wordy quarrel between the petitioner and the deceased Sudha, at that time, the petitioner is said to have demanded dowry and thereby the said Sudha committed suicide on 16.05.2016 by hanging.

3.The learned counsel for the petitioner submitted that the petitioner has been languishing in jail from 19.05.2016 and he is nothing to do with the alleged offence. Further, the petitioner is willing to abide any conditions imposed by this Court.

4. The learned Government Advocate (Crl. Side) vehemently opposed for granting bail to the petitioner on the ground that very serious

S.VAIDYANATHAN, J kal allegations have been levelled against the petitioner and that the investigation is pending in this case and if the petitioner is released on bail, he will tamper the witnesses and hinder investigation.

5.Having gone through the averments, the ingredients of Sections 306 and 107 IPC is made out or not has to be decided during investigation and at the time of trial. As serious allegations has been levelled against the petitioner, this court is not inclined to grant the relief sought for by the petitioner and the petition is dismissed.
