Respondents PRAYER: The petition has been filed under Section 397 and 401 of Criminal Procedure Code against the order passed by the learned Family Court, Salem in M.C.No.59/2007 dated 08.12.2010 and it has to be set aside as illegal, extraneous,exaggerated and against the law.

ORDER

The Criminal Revision has been filed as against the order passed by the Family Court in M.C.No.59 of 2007, directing the Revision Petitioner to pay Rs.1,000/- per month as a maintenance to the first respondent and another sum of Rs.500/- per month to the minor child.

2.No representation on either side.

3.As the revision is pending from the year 2011, this court perused the orders of the Trial Court and materials and is of the view that the Revision itself can be disposed of on merits. 4.On a perusal of the order passed by the Trial Court / Family Court and taken note of the evidence of PW1 & PW2 particularly PW2 Muthavalli and Ex.P1 to Ex.P3, P4, P8 to P10, considered the entire facts. The Family Court has directed the Revision Petitioner to pay a sum of Rs.1,000/- to his wife and Rs.500/- to the second petitioner, who are the respondents herein.

5.This court after analyzing the evidence available on record is of the firm opinion that the order passed by the Family Court does not require any interference and there is no illegality what so ever.

6.Hence, the revisional jurisdiction cannot be invoked as against the reasoned order of the trial court which was passed as per law and the same is dismissed.
