O R D E R

This Writ Petition is filed to issue a Writ of Mandamus directing the respondent herein to receive the application of the petitioner dated 08.03.2021 in Form CCPA and the prescribed fee for the grant of a Autorickshaw Permit to operate the vehicle within radius of 30 km distance from Salem Town Old Bus Stand, Salem District and to consider the same.

2. Mr.K.K.Ramesh learned Government Advocate takes notice for the respondent.

3. The grievance of the petitioner is that though the petitioner has submitted an application on 08.03.2021 for auto rickshaw permit, the respondent has refused to receive the same. https://hcservices.ecourts.gov.in/hcservices/

This Court, on earlier occasion, while entertaining similar writ petition in W.P.No.932/2021 dated 27.01.2021, the respondent has taken a stand that the Salem Bus Owners Association has filed writ petition in W.P.No.30613 of 2019, objecting for grant of new autorickshaw permits and the same is pending, of course, without any interim order and if any application is received by them in the prescribed format, the same will be considered on merits of the application. The said writ petition was disposed of on 27.01.2021 by directing the respondent to consider the application of the petitioner within a stipulated time.

5. Therefore, following the earlier order passed by this Court in W.P.No.932 of 2021 dated 27.01.2021, this Court is inclined to dispose of this writ petition with the following direction. The petitioner shall apply for Autorickshaw permit in the prescribed format by paying necessary fee within a period of two weeks from the date of receipt of a copy of this order and if any such application is filed by the petitioner, the same shall be considered by the respondent on merits of that application within a period of three weeks therefrom.
