O R D E R

This writ petition is filed seeking to quash the impugned order dated 05.08.2024 and to pay the remaining interest amount of Rs.9,14,963/- in 24 equal monthly instalments.

2. When the matter came up for admission, the Learned Counsel for the petitioner submits that an appeal has been filed with reference to the damages amount and they will abide by the orders of the Appellate Court as the case may be. As far as the interest is concerned, the total amount now claimed by the respondents is said to be Rs.9,14,963/- and they may permitted to pay the same in equal monthly installments.

3. Mr.Arun Dhanapalan, Learned Counsel taking notice for the respondent, sought time to get instructions.

4. Considering the innocuous nature of the prayer that is made and since the impugned order is not being set aside, but on the other hand, this Court is only granting time for instalments to pay the interest amount, the writ petition is disposed of at the admission stage without adjourning the matter as prayed for by the Learned Counsel taking notice for the respondent. 5. In view thereof, this writ petition is disposed on the following terms: (i) The petitioner will be entitled to pay the interest amount in 15 equal monthly instalments. The first instalment shall be paid on or before the 7th day of every calendar month starting from the month of April 2026. (ii) If the petitioner fails or omits to pay even one instalment, the respondent will be entitled to proceed the matter to realise the entire amount without any further reference to the Court.

There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.

2. It is seen that, in the prayer portion of the order dated 24.02.2026, the reference number relating to the impugned proceedings has been wrongly mentioned as "Ref. No. TN/RO/CHN/South/5413/Recovery/Div-33/CP3/2024" instead of "Ref. No. TN/RO/CHN/South/85413/Recovery/Div-33/CP3/2024".

3. In view of the above, the Registry is directed to correct the reference number of the impugned proceedings in the prayer portion and issue a corrected copy of the order.
