ORDER : The Court Made the following order :- The petitioner who was arrested on 14.01.2021 for the offence under Sections 147, 148, 341, 326, 307, 506(ii) & 147, 148, 341, 302, 506(ii) of I.P.C. in Cr.No.12 of 2021 on the file of the respondent police, seeks bail.
2.It is the case of the prosecution that the petitioner along with the other accused attacked the defacto complainant's elder brother's son due to which, he died. The petitioner is arrayed as the third accused in the case.
3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and that he has been falsely implicated in this case. 4.The learned Additional Public Prosecutor would submit that the aim of the accused is to kill some other person, however, the deceased was murdered and would further submit that investigation in this case has been completed and charge sheet has been filed and it is in PRC stage.
5.Considering the nature of the offence that the deceased was brutally murdered, this Court is not inclined to grant bail to the petitioner.
