ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to the Respondents 2 and 3 are dispensed with.

2. The present writ petition has been filed praying for a writ of Mandamus directing the 1st respondent to disqualify the 2nd and 3rd respondent in Tender No.03 of 2025 dated 12.12.2025 and consequently award the work to the petitioner in Tender No.03 of 2025 dated 12.12.2025.

3. Mr.Jayesh B.Dolia, learned Senior Counsel appearing for petitioner would submit that respondents 2 and 3 may not satisfy the eligibility criteria set out in the tender and thus, both respondents 2 and 3 are to bedisqualified. Aggrieved by the fact that they are also being considered, petitioner had preferred an appeal before the Commissioner, Commissionerate of Prohibition Excise, Government of Tamilnadu.

4. Learned Special Government Pleader appearing for 1st respondent would submit that though the appeal was actually submitted before the 1st

respondent, the Commissioner as a matter of fact forwarded the appeal papers to the Secretary to Government, Home, Prohibition and Excise Department. He would submit that the Secretary would pass appropriate orders in the appeal after issuing notice to petitioner and respondents 2 and 3, within a time period to be fixed by this Court.

5. Learned Special Government Pleader would also bring to the notice of this Court that they had already approved the L1 Bidder namely viz., Pioneer Arunachalam Packaging Private Limited, 2nd respondent herein for getting QR Code stickers for packing empty liquor bottles, for a period of three years vide G.O.Ms.No.68 dated 19.02.2026. A copy of which was also furnished to the learned counsel for petitioner.

6. Learned counsel for respondents would further submit that in view of the above G.O.Ms.No.68 dated 19.02.2026., the appeal would also become infructuous, not agreed by learned Senior Advocate for petitioner.

7. This Court do not propose to express any opinion on the merits of the above submission. It is open to the appellate authority to decide the matter in accordance with law, all rights and contentions of the parties are left open.

8. The writ petition stands disposed of with the above observations. No costs. Consequently, the connected miscellaneous petitions are closed. 03-03-2026 Index: Yes/No Speaking/Non-speaking order MKA
