for the issuance of a Writ of Declaration, declaring the action of the respondents debit freezing the saving bank account bearing Account No.1645155000046956 maintained with the 4th respondent and savings bank account bearing account No.501320624 maintained with the 5th respondent as illegal and consequently, direct the 4th respondent to de-freeze the bank account No.1645155000046956 and 5th respondents to de-freeze the bank account No.501320624 there by enabling the petitioner to operate the same.

For Petitioner : Mr.N.U.Pressanna For R1 to R3 : Mr.A.Gopinath Government Advocate (Crl.side) O RDER This Writ Petition has been filed for declaration, declaring the action of the respondents debit freezing the saving bank account bearing Account No.1645155000046956 maintained with the 4th respondent and savings bank account bearing account No.501320624 maintained with the 5th respondent as illegal and consequently, direct the 4th respondent to de-freeze the bank account No.1645155000046956 and 5th respondents to de-freeze the bank account No.501320624 there by enabling the petitioner to operate the same.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondents 1 to 3 and perused the materials available on record.

3. The petitioner is an accused in Crime No.244 of 2024 for the offences punishable under Sections 275 and 123 of BNS, 2023 read with Section 24(1) of

Tobacco Act, on the file of the third respondent. Pursuant to the registration of FIR, the third respondent requested the fourth and fifth respondents to freeze the account of the petitioner, since the entire crime proceeds have been deposited in the account maintained by the petitioner with the respondents 4 and 5 herein.

4. Now, the investigation is still pending. Therefore, pending investigation, the direction sought for in this petition cannot be granted.
