Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents herein to give police protection to safeguard the life, liberty, and property of the petitioner which is situated at survey No.39/30A Andagalorre Gate, Rasipuram, Namakkal, Tamil Nadu measuring to an extent of 0.1315 sq mts pursuant to the complaint dated 05.06.2024 filed by the petitioner with the 1st respondent. O RDER This Writ Petition has been filed for direction directing the respondents herein to give police protection to safeguard the life, liberty, and property of the petitioner which is in Survey No.39/30A sitauted at Andagalorre Gate, Rasipuram, Namakkal, Tamil Nadu measuring to an extent of 0.1315 sq mts pursuant to the complaint dated 05.06.2024.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondents 1 and 2 and perused the materials available on record.
3. The petitioner owned property comprised in Survey No.39/30A sitauted at Andagalorre Gate, Rasipuram, Namakkal, Tamil Nadu measuring to an extent of 0.1315 sq mts. While being so, the third respondent is disturbing the peaceful possession and enjoyment of the subject property and also not permitting the petitioner to put up compound wall in front of the property. Therefore, the petitioner lodged a complaint seeking police protection to the life and enjoyment of the property.
4. It is seen that the petitioner lodged a complainant seeking police
protection for the property. The police protection can be granted only to the life and limb of a person.
5. Therefore, the direction sought for in this petition cannot be granted. However, the petitioner is at liberty to approach the Civil Court for appropriate relief.
