Civil Suit filed under Order IV Rule 1 of O.S.Rules, 1956 read with Order VII Rule 1 of CPC, 1908 read with Section 7 of the Commercial Courts Act, 4/2016 as amended for i) directing the 1st defendant to pay to the plaintiff a sum of Rs.3,03,75,000/- (Rupees three crores three lakhs and seventy five thousand only) together with further interest at 12% per annum on the principal sum of Rs.2,55,00,000/- from the date of plaint till the date of realization;
ii) for a permanent injunction restraining the defendants, their agents, servants or anybody claiming through or under them from in any manner releasing, distributing, exhibiting or exploiting the film titled "SABDHAM'" (Tamil, Colour) in all languages anywhere in the world in Theatres including in any other Digital formats such as Satellite, OTT Platforms, etc., and iii) To award the costs of the suit.

JUDGMENT
When the matter was taken up today, producing a joint memorandum of compromise dated 22.9.2025, duly signed by the plaintiff, the contesting first defendant and the fourth defendant, a plea was made on their behalf for recording of the same and decreeing of the suit in terms thereof.

While the plaintiff, R.Purushothaman and the first defendant, R.Senthil Kumar had been present in open court, having been identified by their respective counsel, Mr.A.Chidambaram and Mr.P.K.Srinivasan respectively, it is seen that defendants 2 and 3 were already set ex parte. The authorised signatory of the fourth defendant viz., B.Vijayganesh Kumar, who was also present in court, had been identified by the learned counsel viz., Ms.Indira Priyadharshini.
3. For ready reference, the scanned images of the joint memorandum of compromise are appended hereunder:-

It is relevant to note that as per the terms of the joint memorandum of compromise, the fourth defendant, on behalf of the first defendant, had produced three Pay Orders drawn on Indian Overseas Bank bearing Nos.736231, 736232 dated 19.09.2025 and 736233 dated 22.09.2025 for Rs.40,00,000/-, Rs.40,00,000/- and Rs.5,00,000/- respectively totaling to Rs.85,00,000/- for handing over the same to the plaintiff, which were, accordingly, handed over to the plaintiff across the table, who had also received them and it is, hereby, recorded.

6. In view of the joint memorandum of compromise and the plea made by the parties, the suit stands decreed in terms of the joint memorandum of compromise, which shall form part of the decree. It is also made clear that the interim order already granted by this court stands vacated. The plaintiff shall be entitled to refund of court fee in accordance with law. No costs. The connected pending interim Applications are closed.
