The petitioner, who was arrested and remanded to judicial custody on 27.02.2023, for the alleged offences punishable under Sections 392, 394, 395, 397, 412 of IPC, in Crime No.32 of 2023, on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that the accused, by assaulting the de-facto complainant with iron rod and also be threatening him, have robbed a Maruti Swift car bearing registration No.TN 74 Q 4770, a mobile phone and a sum of Rs.5000/- from the de-facto complainant. Hence the case.

3. Learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case, since he has got some previous cases. He further submitted that the petitioner is in custody from 27.02.2023 and he is prepared to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

Learned Additional Public Prosecutor appearing for the respondent police submitted that the petitioner is a habitual offender, against whom, 7 previous cases are pending and also he is history sheeted in H.S.No.693 of 2022 on the file of the respondent Police Station. He further submitted that as far as this case is concerned, the petitioner (A7) along with other accused, have assaulted the de-facto complainant with iron rod and robbed a Maruti Swift car bearing registration No.TN 74 Q 4770, a mobile phone and a sum of Rs.5000/- from him. He also submitted that the petitioner was arrested very recently on 27.02.2023, hence, he vehemently opposed for grant of bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the entire materials available on record.

6. Taking into consideration the facts and circumstances of the case, the submissions made by the learned Additional Public Prosecutor and taking

note of the fact that the petitioner were arrested very recently and also considering the previous antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the Criminal Original Petition stands dismissed for the present.
