ORDER

(Order of the Court was made by C.V.Karthikeyan J.) This petition has been filed seeking to condone the delay of 130 days in filing the appeal, against the judgment and decree dated 26.12.2024 made in H.M.O.P.No.611 of 2019 on the file of the Principal Family Court, Coimbatore. 2.

As a matter of fact, the Principal Family Court, Coimbatore, had examined two separate petitions, one filed for divorce, against which, the

present appeal has been filed and other seeking maintenance filed by the petitioner herein. While examining the grounds for divorce, the Principal Judge, Family Court, Coimbatore, had stated that the marriage had irretrievably broken down and therefore, the divorce should be granted. That is not a ground stated in the statute as a ground for granting divorce. With respect to the reasons, it had been stated that owing to medical issues and to make financial arrangement, the petitioner was not able to file the appeal within the stipulated time. 3.Notice had been directed and the learned counsel for the respondent had entered appearance and the counsel has not time to file the appeal. 4.After examining the judgment of the trial Court, we are of the opinion that arguable points have been raised. Therefore, the delay stands condoned and the petition is allowed. Registry to number the Appeal, if it is otherwise in order.
