This miscellaneous petition has been filed to condone the delay of 48 days in filing the appeal.
2. Heard both sides.
3. Considering the submissions and the reasons stated in the affidavit, this Court is of the view that the delay may be condoned, on payment of cost.
4. Accordingly, the delay is condoned on payment of cost of Rs.500/- (Rupees Five Hundred only) by the petitioner to the Tamilnadu Legal Aid Services Authority, Chennai, on or before 30.10.2024.
5. On payment of cost, the Registry is directed to number the appeal and post it for admission on 04.11.2024, if the same is otherwise, in order.
6. If the cost is not paid on or before 30.10.2024, this C.M.P. stands dismissed without further reference to this Court.

Today, the appeal filed by the husband has been listed along with the petition to condone the delay. Since both the appeals are connected, it has to be heard together.
Registry is directed to number the appeal in A.S.SR.No.30747/2024, if it is otherwise in order and post along with A.S.No.34/2024 for hearing.

This appeal was filed by the wife.
The husband has filed an appeal along with the petition to condone the delay.
Today, the condone delay petition is ordered in C.M.P.No. 9320 of 2024 in A.S.SR.No.30747/2024. Since both the appeals are connected, it has to be heard together. Therefore, this appeal de-part heard.
2. Post this appeal along with the connected appeal filed by the husband on 04.11.2024.
