C.M.P.Nos.5409, 5411, 5415, 5418, 5419 & 5422 of 2023 in S.A.No.161 of 2010 G.ARUL MURUGAN, J., The 1st and 2nd respondents in this Second Appeal died and the miscellaneous petitions in C.M.P.Nos.5418, 5419, 5422 of 2023 are filed to (i) condone the delay of 21 days in filing application to set aside the abatement, (ii) set aside the abatement, (iii) bring on records of the petitioners herein as legal heirs of the deceased first respondent, respectively.

The miscellaneous petitions in C.M.P.Nos.5409, 5411, 5415 of 2023 are filed to (i) condone the delay of 1616 days in filing application to set aside the abatement, (ii) set aside the abatement, (iii) bring on records of the petitioners herein as legal heirs of the deceased second respondent, respectively.

This Court by order dated 10.03.2023, issued notice to the respondents. Today, the counsel has entered appearance for the proposed respondents 9 to 12 in C.M.P.No.5418, 5419 & 5422 of 2023 and for the proposed respondents 13 to 16 in C.M.P.Nos.5409, 5411 & 5415 of 2023. 4.

Perused the affidavit filed in support of these petitions and also having satisfied with the reasons, these C.M.P.s are ordered. Registry is directed to carry out necessary amendments in the second appeal in S.A.No.161 of 2010. 6.
