Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 5 to take action against the illegal construction being made by the sixth respondent in respect of Survey No.545/1A1 and Survey No.545/4 Pendarahalli-2 Village, Pochampalli Taluk, Dharmapuri District, within the time as may be stipulated by this Hon'ble Court.

O R D E R

(Order of the Court was made by S.M.SUBRAMANIAM, J.) With reference to the allegations of unauthorized constructions put up by the sixth respondent in the subject property, the learned Special Government Pleader appearing on behalf of the respondents 1, 2 and 4 and Mr.V.Nanmaran, learned Additional Government Pleader appearing on behalf of the respondents 3 and 5 would submit that actions have already been initiated, and notices have been issued to the violators seeking relevant

documents.

2. Since actions have already commenced and instructions have been issued not to provide electricity service connections, the respondents 1 to 5 are directed to continue the actions by following the due procedures as contemplated under the Act and Rules and by affording an opportunity to the parties. In the event of identifying unauthorized constructions, they are to be demolished by following the procedures. The sixth respondent is also to be provided with an opportunity to defend his case regarding the allegations set out by the petitioner. The said exercise shall be completed as expeditiously as possible.

3. Accordingly, this writ petition is disposed of. Consequently, the connected miscellaneous petition is closed. No costs. (S.M.S.,J.) (K.R.S.,J.) 07.03.2025 skr Index : Yes
