O R D E R

The petitioner apprehends arrest for the alleged offence under Sections 2(16), 9, 39(A)(D)(S), (3), 50, 51(1), (2), (3), 52, 56, 57, 58(C) of Wild Life Protection Act, 1972 in Crime No.WLOR.03 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that on 23.12.2025 at about 11.45 a.m, the petitioner along with other accused was found illegally smuggling a Pangolin. Based on the said allegation, the present case has been registered against the petitioner.

The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the petitioner along with other accused was found illegally smuggling a Pangolin, which is a protected species. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to either side submissions.

6. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the petitioner along with the other accused has smuggled very precious wild life species, namely Pangolin. Though there is no previous case against the petitioner, in view of the trafficking the endangered wild species, if the petitioner is enlarged on anticipatory bail, they 2/4

would be emboldened to do similar offences. For this, this Court should not give any room. Hence, this Criminal Original Petition is dismissed. 05.03.2026 DRL To 1.The Inspector of Police, Forest Range Officer, Tiruvallur Range, Tiruvallur District.
