ORDER

This petition has been filed seeking extension of time from 30/08/2024 to any further date to comply the condition imposed by this court in Order dated 31/07/2024.

The learned counsel would submit that this court while disposing of CRP.NPD.Nos.4908 and 4916 of 2023, by order dated 31.07.2024, had directed the revision petitioner/respondent/defendant to pay a sum of Rs.50,000/- to the plaintiff/respondent herein on or before 30.08.2024 as cost, for getting condonation of delay.

It is submitted by the learned counsel for the petitioner that the petitioner had taken a Demand Draft for Rs.50,000/- dated 16.08.2024 which was refused by the respondent counsel and so the petitioner filed the memo along with Demand Draft before the Trial Curt on 27.08.2024. However, the same was returned on 29.08.2024 stating that nowhere in the order dated 31.07.2024, the Court had permitted the petitioner to submit Demand Draft for the cost imposed. Therefore, the petitioner was unable to comply with the order.

4. The learned counsel for the petitioner in this CMP would submit that the petitioner is ready to deposit the amount by way of cash to the credit of O.S.No.190 of 2015 and she would seek for extension of time to do so. 2/4

Considering the above, the time granted in CRP.4908 of 2023 dated 31.07.2024 is extended and the petitioner is permitted to deposit the amount of Rs.50,000/- [Rupees Fifty thousand] to the credit of O.S.No.190 of 2015 on the file of the Additional Sub Court No.II, Dharapuram, on or before 30.04.2025.

6. This petition is ordered accordingly.
