ORDER

This Court on 23.11.2016 has passed an interim order in W.M.P.No.31723 of 2016 in W.P.No.36940 of 2016, as follows_ "The 1st respondent is directed to pay the terminal/retirement benefits payable to the petitioner on account of his compulsory retirement, within a period of four weeks.

petitioner. Merely because this interim order is passed, the petitioner shall not claim any equity on that ground."

2.Now, the present contempt petition has been filed by the petitioner alleging non-compliance of the said interim order dated 23.11.2016 passed by this Court. 3.Today, when the matter is taken up, the learned Additional Government Pleader appearing for the respondent submitted that as against the said interim order passed by this Court, Writ Appeal in W.A.No.639 of 2017was filed. The said Writ Appeal was dismissed on 13.06.2017, against which SLP was filed before the Hon'ble Supreme Court in SLP.(C).No.18869 of 2017 has been filed. In the said SLP, interim stay has been granted by the Hon'ble Supreme Court on 31.07.2017.

4.Since interim stay has been granted in the appeal, nothing survives in the present contempt petition. Hence, the Contempt Petition is closed.
