ORDER

The writ petition has been filed to direct the respondents 1 to 3 to take action against the respondents 4 and 5 on complaints dated 13.01.2026, 14.02.2026 and provide adequate police protection to ensure lift access, electricity connection to the 3rd floor at Balapadmam Apartment, Door No.129/64, Harrington Road, Chennai - 600 030. 2.The petitioner is a senior citizen and is a tenant of the premises at 3rd floor, Balapadmam Apartment, Door No.129/64, Harrington Road, Chennai - 600 030. The original landlord had expired and his legal heirs have disputed the ownership of the said premises. They also filed a suit for declaration and recovery of possession, which is pending in Tr.CS.No.31 of 2022 on the file of this Court. In the said suit, the petitioner herein is also one of the

parties. Thereafter, the 4th respondent herein has filed an application in O.A.No.121 of 2022 in Tr.CS.No.31 of 2022, seeking an injunction to restrain the respondents 1 to 4 therein from collecting the lease rental with regard to the subject property. The 4th respondent has also filed an application in O.A.No.122 of 2022 in Tr.C.S.No.31 of 2022, seeking an injunction to direct the 5th to 13th respondents therein to deposit their rent to the credit of the suit. This Court, by an order dated 07.04.2022, allowed the aforesaid applications and permitted the 5th to 13th respondents therein to deposit the rents for the said premises to the credit of Tr.CS.No.31 of 2022 together with arrears. Although the said order was complied with, the 4th and 5th respondents herein had locked the access to reach the third floor by closing the lift.

Therefore, the petitioner could not be able to reach his premises and hence had lodged a complaint before the 3rd respondent. The 3rd respondent, after enquiring into the complaint by issuing notice to the petitioner as well as the 4th and 5th respondents, had directed the 4th and 5th respondents grant permission to the petitioner to access his premises. However, the 4th and 5th respondents locked the lift and restricted the petitioner's access to reach his premises.

3.This Court is of the view that inspite of specific directions by the police authorities, the private respondents are denying access to the petitioner to enter his premises. Thus, this Court directs the 3rd respondent to further enquire into the complaint lodged by the petitioner and ensure that the petitioner can have a clear access to his premises without any disturbance from the 4th and 5th respondents. If the said respondents once again indulge in locking the lift and disturbing the petitioner's access, the 3rd respondent is directed to register an FIR as against them and take appropriate course of action in accordance with law. 4.With the aforesaid direction, the writ petition stands allowed.
