..Respondents PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondents to pay interest @ 10% for the belated payment of terminal benefits such as Gratuity, Provident Fund, Leave Salary and Commutation amount to the petitioners and to pass orders.

ORDER

The writ petition is filed seeking a direction to the respondents to pay interest at 10% for the belated payment of terminal benefits.

2. It is the case of the petitioners that they have served in the first respondent-Corporation and had retired from service on 31.05.2024 and 30.06.2024 respectively. The respondents had settled the Gratuity, Leave Salary, Provident Fund and Commutation after a delay of more than 1 1⁄2 years. The petitioners would submit that the respondents are legally bound to pay interest to them. Therefore, the petitioners made individual representations to the respondents to pay the interest at the rate of 10% p.a., for the delay in settling the terminal benefits of them . Since there is no response, the petitioners are before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the Earned Leave Salary, Gratuity Amount and PF and

Commutation Amount has been paid to the petitioners belatedly for no fault of them. Hence, the petitioners are entitled to interest on the same. Therefore, a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Earned Leave Salary, Gratuity Amount, PF and Commutation Amount within a period of one (1) month from the date of receipt of a copy of this order. No costs.
